Summer 2006 has begun (in case you didn’t already know by the temperature) and on July 1st your new 2006-2007 DAHU Board became effective. The official swearing in will take place at the July 19th luncheon and I hope many of you will attend. I promise it will be fun and the new Board will greatly appreciate your support. I have nicknamed this year’s Board DREAM TEAM because they believe that YOU are the U in SUCCESS. |

I am very proud to be part of this enthusiastic team of extraordinary volunteers who want to exceed your membership expectations and be a conduit of your professional success and personal development. Together we plan to give DAHU members programs, education and publicity that entice you to attend more functions and have some fun. As my Dad would always say, “life is just too short not to have fun whenever possible.” Let me tell you a few things about the DREAM TEAM members
Jacqueline St. Hilaire – Incoming President – 2006 Quadruple Award Winner!! DAHU, TAHU and NAHU! Also known as Miss “I Can Do That!” She never stops. Tiger Woods has nothing on Jacqueline! She is a person deserving of great accolades who could also give Tiger Woods a run for his money on the golf course. David Weber – Treasurer – The Wizard – (also known as the man behind the curtain.) David is the creative genius of our website and our audio/visual expert at the luncheons. As Treasurer he dreams in dollar signs; for real! He helps to keep DAHU in the black and has promised we will have money to do creative things this year. (He doesn’t remember saying that, but I have witnesses.) Valerie Toups – Secretary – Miss Congeniality – (let me lift you up). DAHU is indebted to her for all the Awards she helped us win these past two years in addition to creating the DAHU Chapter Awards Program. Valerie’s mantra is to make everyone feel appreciated! Something we should all do more often for lots of folks in our lives. Thank you, Valerie.
MaryLou Hudman – Past President – Miss YEHAW! MaryLou is NAHU Membership Chair for the NAHU Board of Trustees in addition to her DAHU Board position. At NAHU Convention she told 900 folks that the new Membership call to action will be YEHAW because TX will be leading the charge. She will help all Chapters across the nation attract and retain members. I think the goal is to reach 22,000 by June 2007! Kathy Powell – Newsletter Editor – Miss Cool! (she does not let the heat get her down). Kathy handles those deadline pressures like a pro especially when Board members are late in getting their articles to her (like the one I am writing now at midnight). She would love to get articles from members….what would you like to share? How about some comments on our NEW WEB-BASED NEWSLETTER? You go, GIRL!!
John Mosier – Public Service – Mr. Nice Guy! He told me to tell you something about being a redneck and drinking moonshine but I don’t believe it. I’m a doubting Thomas; he’d have to share the moonshine first . He helps us all be aware of our responsibility to give back to the community and he helps us have fun in the process.
Larry French – Media Relations – Mr. Connected! DAHU has enjoyed monthly notoriety in the Dallas Business Journal and/or the Dallas Morning News all year which won DAHU the National Media Award! Whatever you do, don’t tell him that PR folks make mucho dinero for this type of publicity! We love him just the way he is.
Frank McCaffrey – Texas Legislative and Grass Roots Initiative Program (GRIP) Chair – Mr. GRIP (because he always has a grip and the matter under control). He keeps us all informed about what is happening in the TX Legislature and what impacts our profession or clients. The GRIP fundraising helps to pay for the TAHU Lobbyist! Member Survey - Which fundraiser did you like the best: Night at the Mansion in 2004 or Golf for 4 at Tribute in 2005? You could help decide the direction of the 2006 fundraiser….let Frank know.
David Clampitt – Sponsorship Chair – Mr. Smile – (no matter the task, David does it with a genuine smile to make your day better). You are probably asking how he can smile with such a daunting task. DAHU depends on carrier and vendor support even though we know those budgets are declining. David has been working on a new sponsorship program which could give carriers and vendors double their previous publicity and exposure. Stay tuned! This is really exciting. David is also a successful cohort in the GRIP program.
Tamela Southan – Federal Legislation – Miss Enthusiasm – (passion to see everyone succeed). Tamela’s belief in our industry and our association has her fired up for a new legislative year and the groundwork for the 2008 Presidential election. If you think you just saw a tornado go by, more than likely it was Tamela because she creates excitement wherever she goes. Watch out Washington, DC because this gal is organized and ready!
Linda Taylor – Awards Chair – Miss Quiet Dignity – (the person who provides reason in chaos). Every successful team needs a person who is able to throw a lifeline when the group falls overboard. Linda will help us find our way to Award recognition by keeping us on track when the detour looks like more fun! Her quiet persuasive manner is award winning in itself.
Donna McCright – Education Chair – also a Past President of DAHU - Miss Education – (DAHU, TAHU, NAHU recognized for her work in education). Donna has helped write and been successful in TDI passage (Texas Department of Insurance) of more CE classes than anyone else I know. Her goal is to provide you the education YOU want for your sUccess and she wants to make it fun! What else could a person want? PLEASE TELL HER!!
Marcia Snell – Membership Chair – This will be Marcia’s first year on the Board so I don’t yet know what nickname to give her. I’ll have to think about it over the next few months and if you have any suggestions, let me know. I do know that we are all very excited to have her. Look for some exciting membership drives and member enticing programs this year; she even has a committee already lined up!
Darrin Spradley – Retention Chair – This is also Darrin’s first year on the Board and again I want some time to find the right nickname. He is a great personality fit for the DREAM TEAM and has already added to the fun. I’m sure he will find a way to convince folks not to “drop out” of DAHU. Darrin is now the 5th man on the Board and will make Board participation less daunting for other daring men who might be interested. In addition to the Full Board, we will have some AD HOC Committee members as approved by the DAHU Executive Board. They currently are:
Jim Bowman & Sherry Harris - Broker/Agent Liaison – Jim is a long time DAHU member and all around good guy anxious to help the Board assist Broker/Agent members towards more success. Sherry is a carrier rep who is new to DAHU but many years in the industry and anxious to work on this very important project.
Patrick Wilder & Lorrinda Lattimer – New Agent Mentoring Program – Patrick is a long time NAIFA member and Lorrinda has transferred from CAHU. They believe that new blood is crucial to our industry and they will be working with TAHU’s Joanna A. and Peggy B in creating a mentoring environment for new DAHU agents.
Andrea Prendergast & Erika Rockett – Membership Activity – will work with Marcia Snell in delivering social programs to the membership and helping with all program registration.
Geneva Hamilton – Legislative Key Contact – Geneva is an active constituent of Congresswoman Eddy Bernice Johnson and will be helping to promote DAHU and NAHU initiatives with this office.
Last but not least is me! RoseMary Deininger – DAHU President – Color me Proud and Ecstatic! The DREAM TEAM is my dream come true – great folks working for a fabulous membership towards a very successful year! What could be better? Now for the important question – What do you think of the picture? I haven’t found one that I totally like so I think I’ll use a different one each month. Helping Consumers Find Us ? How do consumers find agents? How do consumers get information about small group health plans, what a deductible is or how to purchase a temporary plan? |

Well, the TDI has come up with a consumer friendly website, www.texashealthoptions.com to answer these and many more questions for consumers.
The Texas health options website is a direct result of SB 261, legislation that created a program to educate the public on the value of health coverage and to increase public awareness of health coverage options. It also created a task force made up of carrier partners, consumers, agents and other entities to come up with ideas to get this information out to consumers. I have a seat on this task force and have already been able to come up with some suggestions for getting agents more visibility on this website. If you have a minute, review the site and give me your feedback. I will be happy to present more ideas to the TDI. Also, add the link to your home page, or your local chapter’s homepage, talk about it at chapter luncheons and with your clients.
SB51. I know I mention this every month but you keep calling and emailing me about it … so I figure everyone is still interested in it. At this moment, there are no final rules posted. Based on information from the Commissioner, I expect to see the rules out in about 10 days. As soon as the final rules are published, we will make them available, or…you can keep an eye on them at: http://www.tdi.state.tx.us/rules/2006/parules.html Did you know that the Lege Council has a teleconference every month? Please make sure that someone from your chapter is attending these conference calls. Invitations are sent out via email about 1 week prior to the meeting. We discuss valuable information that you can pass along to your chapter!
We have added another new face to the LC this year! Joe Phifer will be joining the team as the Key Contact guy. He is also the East Texas president. Joe hit the ground running with ideas about how to recruit new Key Contacts, renovate the KC sign up form and ways to use KCs in the district. If you want to be a KC, please let Joe know.

TDI Adopts Final Rules On SB 51
The much anticipated rules for SB 51 have been published by the Texas Department of Insurance. All in all, I am pleased with the outcome. TAHU has been at the table since this was on the TDI’s plate and we continue to have discussions with them about interpretation. |

Here is at actually eligible for coverage simply because the employer had not notified the carrier of the person’s termination. SB 51 changed all that, requiring employers to continue paying the premium and carriers to continue providing coverage THROUGH the end of the month in which the employer notifies summary, highlighting the most important topics like the grace period, jurisdiction and a few definitions of terms. These rules will help our clients, if our clients are informed. It is now up to us, good professional agents to get the correct information out to them.
The Legislative Council is developing a CE on all of this along with an “Employer Alert” for you to use. Both of these items should be ready soon.
I know that many of you will have questions, comments and concerns about these rules. We know that SB 51 hurts employers. We have heard that from many of you several times but what we need now are specific examples, hard facts, names, dollar amounts, etc. We will take this information to the legislature and talk to them about it. Revisions to SB 51 may be achieved in the 80th session but we will not go to our lawmakers and whine to them. Let’s stay proactive, positive and feed them information that is solid.
Keep in mind that the background of Senate Bill 51 was to eliminate confusion or questions about a person’s eligibility for benefits under his group health plan, so that a medical provider could verify a treatment for the insured person and reliably expect to be paid for it. Too often insurance carriers had paid benefits for someone who had been terminated and wasn’ the insurance carrier about a person’s termination. Fortunately, the new rules provide some exceptions to this.
Major Exception. In general, employers should notify the insurance company or health plan of an employee’s termination the day it happens or as soon as possible afterward. Specifically, the new rules provide that if the termination occurs in the last SEVEN (7) CALENDAR days of a month, the employer has the first THREE (3) BUSINESS days into the next month to tell the carrier and if he tells the carrier during this time, he will not be obligated (and coverage will not be extended) for that next month.
[Example: Employer’s group plan is on a calendar month. He fires Employee A on the 26th day of a 31-day month. He has the first three business days of the NEXT month to tell the carrier about the termination and avoid paying the premium for that following month. Coverage and the employer’s premium obligation therefore ended at the end of the month he fired A. But, if the employer does not notify the carrier until the FIFTH business day of the next month, he will be charged the premium for that employee and any dependents (and coverage will still be in force). for that entire next month.]
Other Exceptions have been provided by the rules that allow an employer to escape this new premium payment obligation, too, such as the following situations:
• The individual has elected to continue coverage under COBRA or Texas group continuation laws.
• The individual has terminated coverage from the plan but remains a part of the group
• The employer has not been paying ANY of the premium
• The employer drops the entire group health plan Other important provisions of the new SB 51 rules.

• “Month” is not necessarily a calendar month. For example, an employer may have a plan that began on the 15th of the month and that’s when his premium is due. Or it can be specifically defined in the contract between the carrier and the policyholder.
• The method of notification can be by “electronic means” which generally is defined to be a carrier’s internet portal, email or fax. Carriers and the group policyholder may agree in their contract that the carrier will accept the notification by U.S. mail.
• The employer is off the hook, also, if a person leaves the group and immediately becomes covered under a new plan. Unfortunately, that former employer is required to verify that his ex employee has new coverage in order to escape the additional premium requirement. Furthermore, if that person’s new coverage falls through or for some reason does not provide coverage during this notification/extended coverage period, the old employer is back on the hook.
Jurisdiction. Where does SB 51 apply? In a nutshell – Texas, Texas, and only Texas. Two examples will illustrate this. First, a New York employer has employees who live and work in Texas. SB 51 will apply to those employees. Or, a Texas employer has employees who live and work in New York. SB 51 does NOT apply to them.
Timing. This is a good opportunity to restate a couple of key dates. SB 51 applies to plans issued or renewed on OR AFTER Jan. 1, 2006. If a plan does not renew until this November, for example, this law does NOT apply to that employer until that renewal point. The final regs become effective July 17th.

The “Leadership” Award is presented to a member of the Board of Directors whose contribution includes consistent attendance and participation in meetings, luncheons and other association events, and who has successfully achieved the goals set forth during the strategic planning meeting for the year.
A. Kathy Powell – DAHU “Newsletter Chair” Board Member since 2004 has been a consistent participant in all events. She has been responsible for providing our membership with a new newsletter vendor that provides DAHU information in a timelier, professional publication.

The “Stellar” Award is presented to an individual members(s) who has demonstrated steady and consistent participation in and support of all DAHU activities.
A. Jim Debi Bowman – Long standing DAHU members, who have been consistent supporters and participants in DAHU events. They currently have their own agency, which was started about 8 years ago.
IV. The 2006 “NOVA” Award winner – Reid Rasmussen
The “NOVA” Award is presented to an individual member who has demonstrated significant new energy and accomplishment on behalf of the association during the last year.
A. Reid Rasmussen – DAHU member that has been involved in the insurance industry for years and active in the association on different boards in the past years. Reid was present at the 2006 NAHU Convention to bring home another award for DAHU, the “Williams G. Wetzel - Excellence in Public Speaking”, that he was responsible for providing all data detail for submittal.
V. The 2006 “Hendershot” Award winner – SafeGuard Dental & Vision
The “Hendershot” Award shall recognize the one company whose support for DAHU’s members and mission exceeds all others. Primary considerations will include carriers’ financial and philosophical support for our chapter. Contributions evaluated may include:

Biography on Mike Smith, LTCP
Mike Smith entered the insurance business in 1993 as a marketing and agent service representative at The Brokerage Inc in Dallas. His primary responsibilities include recruiting and training brokers to sell Group I Insurance products for The Brokerage, Inc. in Dallas.
Mike’s primary aim is to focus on senior related products, like Medicare & Long Term Care Insurance. After more than ten years Mike has conducted hundreds of product seminars and trained thousands of insurance agents nationwide to market senior insurance products.
Mike has been an active member of the Ft Worth Association of Health Underwriters since 1993, and is currently a FWAHU Trustee. He is also a member of the National Association of Insurance and Financial Advisors in Dallas, the Brokers Health Insurance Network, and The Marketing Alliance.
Presently he is an active Board of Directors member for the American Association of Long Term Care Insurance (AALTCI), a national organization representing agents and brokers working within the LTCI profession.
In January 2003, Mike earned the Long Term Care Professional designation, signifying the commitment to remain dedicated in the field of Long Term care Insurance.
Currently the Executive Vice President of The Brokerage, Inc., Mike lives in Highland Village with his wife, Shannon and two children, Kayli, age 11 and Kyle, age 9 and Kinley, age 6 months.

Beth is co-owner of The Ashmore Agency, Inc. along with her husband, Wilburn. They have owned their own insurance agency since 1979. The Agency deals primarily in all aspects of Business Insurance and Financial Planning. They have two daughters, one who attended Texas Tech, one attended Southwestern University, and both married, with 3 girls and a boy between them. They have been in Lubbock since 1977 when they relocated here from Oklahoma. She attended the University of Oklahoma.
